Killer's Trail Terms of Use
These Terms are the agreement between you and Mosaic Studio LLC (“we,” “us”), an independent software studio based in California, United States, covering your use of Killer's Trail. By using the app, you agree to them. If you do not agree, do not use the app. For our studio-wide terms, see the Mosaic Studio Terms of Use; our Privacy Policy is incorporated into these Terms by reference.
License to Use the App
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and use Killer's Trail for your own non-commercial purposes on devices you own or control. This license does not transfer any ownership rights to you.
No Account, No Collection
Killer's Trail has no user accounts and collects no personal information. Your progress is saved only on your device. There is therefore no user-generated content, no social feature, and nothing for us to moderate or delete on your behalf.
Mature Content
Killer's Trail is a thriller containing mature horror themes, intended for older audiences. It is not directed to children under 13. Please check the store age rating before purchasing or playing.
Acceptable Use
- Do not copy, modify, reverse engineer, decompile, or attempt to derive the source code of the app, except to the extent this restriction is prohibited by applicable law.
- Do not rent, lease, sell, sublicense, or otherwise commercially exploit the app.
- Do not use the app in any unlawful way, or to interfere with, disrupt, or compromise its security or integrity.
- Do not remove or obscure any copyright, trademark, or other proprietary notices.
App Store Terms
Killer's Trail is distributed through the Apple App Store and Google Play, and your use is also subject to the terms of the store you downloaded it from. For the Apple App Store, Apple's Licensed Application End User License Agreement applies in addition to these Terms; where these Terms conflict with that EULA, the EULA governs. Apple and Google are not responsible for the app or its content and are not parties to these Terms, except that they are third-party beneficiaries entitled to enforce these Terms against you.
Intellectual Property
The app, including its story, software, text, graphics, logos, and artwork, is owned by Mosaic Studio LLC or our licensors and is protected by intellectual-property laws. The Mosaic Studio and Killer's Trail names, logos, and artwork are our trademarks and may not be used without our prior written permission. All rights not expressly granted are reserved.
Ending Your Use
You may stop using the app at any time by uninstalling it, which also removes the data it stored on your device. Questions? Email hello@mosaicstudioapps.com.
Disclaimer of Warranties
The Services are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or free of harmful components. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.
Limitation of Liability
To the fullest extent permitted by law, Mosaic Studio LLC and its owners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or relating to your use of the Services. To the fullest extent permitted by law, our total liability for any claim relating to the Services will not exceed the greater of the amount you paid us for the relevant App, if any, or twenty U.S. dollars (US $20). Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.
Indemnification
You agree to indemnify and hold harmless Mosaic Studio LLC from any claims, damages, and expenses (including reasonable legal fees) arising out of your misuse of the Services or your violation of these Terms.
Termination
These Terms remain in effect while you use the Services. We may suspend or terminate your access if you violate these Terms. You may stop using the Services at any time by uninstalling the App. Provisions that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and governing law — will survive.
Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the “Effective” date above. Your continued use of the Services after the changes take effect constitutes acceptance of the revised Terms.
Governing Law
These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws principles. You agree that the state and federal courts located in California will have exclusive jurisdiction over any dispute relating to these Terms, to the extent permitted by applicable law.
